Team CarePal Platform Terms of Use

Last updated: October 13, 2026

1. About These Terms

These Platform Terms of Use (the “Terms”) are a legal agreement between you and CND Creations Inc., operating as Team CarePal (“Team CarePal”, “we”, “us”, or “our”). They govern your use of the Team CarePal mobile application, organization web dashboard, Zolo support assistant, and related services (together, the “Platform”).

These Terms apply to the Platform only.

Please read these Terms together with our Platform Privacy Policy, which explains how we collect, use, and protect personal information.

Acceptance. By creating an account, accepting an invitation, or using the Platform, you agree to these Terms. If you do not agree, please do not use the Platform.

Eligibility. You must be at least the age of majority where you live to create an account. If you use the Platform on behalf of an organization, you confirm that you are authorized to accept these Terms for that organization.

Other agreements. If your organization has a separate written agreement with Team CarePal (such as a service agreement, Information Manager Agreement, or Business Associate Agreement), that agreement will govern where it conflicts with these Terms.

2. Definitions

  • Care Partner: a family member, friend, or other person who supports someone receiving care and uses the Platform for that purpose.
  • Care Recipient: the person receiving care whose information may be shared within a Care Community.
  • Care Community: a private group on the Platform where a Care Recipient’s support network, and any connected Organization, coordinate and communicate.
  • Organization: a health, senior care, home care, community, or support organization that uses the Platform to connect with Care Partners and families.
  • Organization User: a staff member, contractor, or volunteer given access to the Platform by an Organization.
  • Your Content: information you enter into the Platform, including messages, journal entries, posts, calendar items, assessment responses, files, and conversations with Zolo.
  • Zolo: the AI-powered support assistant within the Team CarePal app.

3. The Platform

Team CarePal is a care coordination platform. It helps Care Partners, families, and Organizations stay informed, communicate, and coordinate support for a Care Recipient. Features may include shared calendars, messaging, journals, updates from Organizations, burnout check-ins, resource navigation, and the Zolo assistant.

Features available to you depend on your role, your Care Community settings, and, where applicable, the Organization you are connected with. We may add, change, or remove features over time to improve the Platform.

Accessibility. We are committed to making the Platform accessible to people with disabilities and to providing a safe, dignified, and welcoming experience for everyone. We work to identify and remove barriers and to meet applicable accessibility requirements. If you have trouble accessing any part of the Platform, please contact us at admin@teamcarepal.com and we will work with you to find a solution.

4. Not Medical Advice or an Emergency Service

The Platform does not provide medical, clinical, legal, or financial advice. Content on the Platform, including resources, burnout check-in results, and Zolo responses, is for general information and support only. It does not replace advice from a qualified health professional.

The Platform is not an emergency service. Messages and updates may not be seen or answered right away. In an emergency, call 911 or your local emergency number. For mental health crisis support in Canada, call or text 9-8-8.

Organizations remain responsible for the care and services they provide. Team CarePal does not supervise, direct, or guarantee the care provided by any Organization or individual.

5. Zolo

Zolo. Zolo is an AI-powered assistant that suggests resources and supportive information based on your questions, your location, and your burnout check-in results. You choose when to use Zolo; it does not act on its own. Zolo can make mistakes, so please check important information with a trusted source or professional before acting on it.

How Zolo handles your information. Your conversations with Zolo are processed to generate responses within the Platform. They are not used to train third-party AI models. Details are in our Platform Privacy Policy.

By using Zolo, you agree to the uses described in this section.

6. Your Account and Sharing Information About Others

Account security. Keep your login details private and do not share your account. Use a strong password and any additional security features we offer. Tell us right away at admin@teamcarepal.com if you think your account has been accessed without permission.

Accurate information. Please keep your account information accurate and up to date.

Information about others. Care Partners often share information about a Care Recipient or other family members. Before you add someone else’s personal or health information, you confirm that you have their consent or the legal authority to do so (for example, as a substitute decision-maker, agent under a personal directive or power of attorney, or guardian).

Delegated access. Care Community members and Organizations may give others access to information within a Care Community. Access is based on roles. You are responsible for who you invite and what you share. You can change or remove access through your settings or by contacting us.

Organization updates. Where an Organization shares health updates through the Platform, it does so under its own authority and consent processes. Only people designated by the Organization (such as a Care Recipient’s authorized representative) will receive those updates.

7. Organization Accounts

If you use the Platform on behalf of an Organization, the following also apply:

  • The Organization decides who on its team gets access and at what level. It is responsible for its Organization Users’ compliance with these Terms.
  • Custodian responsibilities. Where an Organization is a custodian, trustee, or covered entity under health privacy law, it remains responsible for the health information it controls. Team CarePal acts on its behalf as an information manager, service provider, or business associate under the applicable written agreement.
  • Consent and notice. The Organization is responsible for obtaining any consent and giving any notice required before sharing information with Care Partners through the Platform.
  • User management. The Organization must promptly remove access for Organization Users who no longer need it.
  • Organization Users must handle all information on the Platform in line with their Organization’s privacy policies and applicable law.

8. Your Content

You own Your Content. Team CarePal does not claim ownership of anything you enter into the Platform. Health information shared by an Organization remains under that Organization’s control.

Our limited permission. You give Team CarePal a limited, non-exclusive permission to host, store, process, display, and transmit Your Content only as needed to:

  • operate, maintain, secure, and support the Platform;
  • share Your Content with the people and Organizations you choose, based on your settings and Care Community roles; and
  • create de-identified information as described in Section 9.

This permission ends when Your Content is deleted from the Platform, except for copies kept for a limited time under our retention practices or as required by law.

Confidentiality. We treat Your Content as confidential. We do not sell it, and we do not share it outside the Platform except as described in these Terms and our Platform Privacy Policy.

Your responsibility. You are responsible for Your Content and confirm you have the right to share it. Please do not post content about others that they would not reasonably expect to be shared.

9. Privacy and Data Handling

Our Platform Privacy Policy explains what information we collect, why, who we share it with, and your rights. Key points:

  • We do not sell personal information.
  • We use administrative, technical, and physical safeguards, including encryption in transit and at rest, role-based access, and audit logging. We also maintain cyber liability insurance. No system is completely secure, so please help by protecting your account.
  • Data location. Platform data, including backups and Zolo processing, is stored on Amazon Web Services (AWS) in Canada. A limited number of authorized support staff, including members of our development partner’s team in the United States, may access data from outside Canada when needed to support the Platform. This access is controlled, limited to what is necessary, and logged. Your data remains stored in Canada.
  • De-identified information. We may create de-identified or aggregated information that does not identify any person, and use it for analytics and to improve the Platform.
  • Access and correction. You can ask to access or correct your personal information by contacting admin@teamcarepal.com. Requests about health information held by an Organization may be referred to that Organization.
  • Privacy incidents. If a privacy breach affects your information, we will notify you and the appropriate Organization or regulator as required by law.

10. Acceptable Use

To keep the Platform safe and respectful, you agree not to:

  • access information or Care Communities you are not authorized to see;
  • share another person’s information without consent or legal authority;
  • post content that is abusive, harassing, threatening, hateful, discriminatory, or sexually explicit;
  • impersonate another person or misrepresent your role or relationship to a Care Recipient;
  • use the Platform to send spam, advertising, or unsolicited promotions;
  • attempt to bypass security, probe for vulnerabilities, or disrupt the Platform;
  • upload viruses or other harmful code;
  • use bots, scrapers, or automated tools to access or copy the Platform or its content;
  • try to extract, reverse engineer, or misuse Zolo or the models behind it; or
  • use the Platform for any unlawful purpose.

If you see misuse, please report it to admin@teamcarepal.com.

11. Cost

The Team CarePal app is free for Care Partners and families. We do not charge individuals to download or use it.

Organizations pay for their use of the Platform under a separate written agreement with Team CarePal. Those fees are never passed on to families through the app.

12. Our Platform, Third-Party Services, and Availability

Our intellectual property. The Platform, including its software, design, content we provide, and the Team CarePal and Zolo names and logos, belongs to CND Creations Inc. or its licensors. We give you a personal, non-transferable, revocable right to use the Platform under these Terms. Organizations may use the Platform for their operations as set out in their agreement with us.

Feedback. If you share ideas or feedback, we may use them to improve the Platform without obligation to you.

Third-party resources. The Platform may link to community resources, services, and websites run by others. We do not control them and are not responsible for their content or services.

Availability. We work to keep the Platform available and reliable, but we cannot promise it will always be uninterrupted or error-free. We may pause the Platform for maintenance, security, or updates.

13. Suspension, Closing Your Account, and Your Data

Closing your account. You can stop using the Platform and close your account at any time through your settings or by contacting admin@teamcarepal.com.

Suspension. We may suspend or end access if you breach these Terms, if needed to protect the safety, privacy, or security of others, or if required by law. Where reasonable, we will give notice and a chance to resolve the issue first.

Legal requests. We may disclose information when required by law, such as in response to a court order, subpoena, or valid request from law enforcement or a regulator. We review each request carefully, disclose only what is legally required, and, where permitted, notify the affected person or Organization.

When an Organization removes you. If your access was provided by an Organization, that Organization may remove you from its dashboard. Information the Organization shared with you is then kept read-only and securely stored as the Organization directs. Your own Care Community content stays yours.

What Organizations can see. Organizations can only see information they add to the Platform, and information you choose to share with them, such as messages you send to the Organization or surveys you complete. They cannot see your journals, posts, burnout check-ins, or Zolo conversations unless you choose to share them, whether your account is active or deleted.

When you delete your account. Your access ends and your account is moved to a secure, restricted state.

  • Content you shared with your Care Community, such as posts, messages, and calendar items, stays visible to the remaining members. This keeps the family’s shared history intact for the people still providing care.
  • Your private content, such as journals, burnout check-ins, and Zolo conversations, is not visible to anyone.

We keep your information for up to 7 years from the date of deletion to meet legal and regulatory obligations, then securely destroy or anonymize it. Health information shared by an Organization is retained or returned as that Organization directs. Before deleting, you may request a copy of your personal information.

14. Disclaimers, Limitation of Liability, and Indemnity

Disclaimer. Except as stated in these Terms and to the extent permitted by law, the Platform is provided “as is” and “as available” without other warranties.

Limitation of liability. To the extent permitted by law, Team CarePal is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits or data. Because the app is provided free of charge, our total liability to any individual user for any claim relating to the Platform is limited to CAD $100. Liability to Organizations is set out in their written agreements.

We are not responsible for care, advice, or services provided by Organizations, health professionals, or third-party resources accessed through the Platform.

Nothing in these Terms limits liability that cannot be limited by law, including your rights under applicable consumer protection laws.

Indemnity. To the extent permitted by law, you agree to cover reasonable losses and costs Team CarePal incurs because of your breach of these Terms or your misuse of the Platform, including sharing information without required consent.

15. Where the Platform Is Available and Governing Law

Canada. These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there. If you are a consumer living in another province, you also keep any rights the laws of your province give you that cannot be waived.

United States. If you are in the United States and connected to an Organization there, these Terms are governed by the laws of the state where that Organization’s principal place of business is located, except where federal law applies.

  • Organization information. Information an Organization adds to the Platform is protected under HIPAA through our Business Associate Agreement with that Organization.
  • Your own content. Content you create in the app, such as journals, posts, burnout check-ins, and Zolo conversations, is never shared with your Organization. It is protected under these Terms, our Platform Privacy Policy, and applicable US federal and state consumer health privacy laws. If it is ever affected by a breach, we will notify you and the appropriate authorities as required by law.

Other locations. The Platform is intended for use in Canada and the United States. If you use it elsewhere, you are responsible for following local laws.

16. Changes, General Terms, and Contact

Changes to these Terms. We may update these Terms as the Platform grows or laws change. For material changes, we will give you notice in the app or by email at least 30 days before they take effect. Continuing to use the Platform after that means you accept the updated Terms. If you do not agree, you may close your account.

Additional terms. Some features or services may come with additional terms that we will show you before you use them, for example by asking you to select “I agree.” Those terms become part of these Terms. If they conflict with these Terms, the additional terms apply to that feature.

Entire agreement. These Terms, any additional terms you accept, our Platform Privacy Policy, and any written agreement with your Organization make up the full agreement about the Platform.

Severability. If any part of these Terms is found unenforceable, the rest stays in effect.

No waiver. If we do not enforce a right right away, we have not given it up.

Assignment. You may not transfer your rights under these Terms. We may transfer ours as part of a merger, acquisition, or sale of assets, with your information still protected as described in our Platform Privacy Policy.

Language. These Terms may be provided in French. If versions differ, the English version applies to the extent permitted by law.
